Pirated software (warez)
Definition: Any software that is copyrighted and is not intended to be freely available without paying.
It is strictly prohibited to use DeltaArc Networking services to transfer any material that infringes any copyright, patent, trade secret, trademark, secrecy agreements or any other rights of any other third party.
You must have the permission of the owner of the material to distribute it. If you use a domain name on our server, it must respects all copyright, trademark, service mark or any other similar rights of any other third party.

Background process related to IRC or chat activities
It is strictly prohibited to run an IRCD ( or any chat room program ) or IRC bots of all kinds unless you are ordering an account that allow those kind of background process. If you are caught running unauthorized background process, they will be killed and you will be warned. After three warnings, your account will be suspended until an agreement is reached. If you are running more background process then you are allowed, they will be killed and you will be offered to either stop running extra background process or to pay for them. After three warnings, the account is suspended.

Other Background Running Programs
All background running process are dealt with on a per application basis. If extra costs are related to the process, it is up to the user to decide if he wish to pay for them and be able to run the process. We do allow shoutcast servers on a per application basis.

Pornographic material
We currently do NOT allow any pornographic material at this time. Any user caught having pornographic material on his account will be warned and requested to remove the material within 48 hours. After those 48 hours the material will be deleted. A second offence results in the account suspension.

CGI Scripts
Each DeltaArc Networking Account comes fully equipped with its own pre-configured CGI-Bin. Customers are free to use any CGI-Scripts provided with their account or add any additional ones they require. If a CGI-Script affects the server or network performance, it will be shut down without any prior notice.

Server Resources
DeltaArc Networking accounts operate on shared resources. If you abuse the resources of the server and it affects the performance of the server in an abusive manner, you will be contacted. If this occurs to often, it may lead to a termination of your account.
You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. We reserve the right to terminate or limit such usage.

Commercial e-mailing
You may NOT use anything that is part of the DeltaArc Networking network to send any kind of SPAM, e-mail flames, e-mail bombs or any other unsolicited e-mail message. Your domain must NOT be contained in any part of an email message described above. A message considered unsolicited is if it is sent in violation of a newsgroup charter or it is sent to someone that has not requested the message and do not wish to receive it. If you are found responsible of spamming, we will disable your account until the investigation is cleared. Additionally, we reserve the right to impose a 100$ penalty for each violation of this agreement. We will also terminate your account without any refund.
Network disruptions and unfriendly activity
Use of the DeltaArc Networking service for any activity which affects the ability of other people or systems to use DeltaArc Networking Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. DeltaArc Networking will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
Unauthorized access
Use of the DeltaArc Networking's service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of DeltaArc Networking's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending DeltaArc Networking account is subject to immediate termination.

Modifications of this AUP
We reserve the right to modify this AUP at any time giving a 10 days notice. If you wish to cancel your services following a modification of this AUP, we will refund the services that you have not used.
