Refusal of Service
DeltaArc Networking reserves the right at its sole discretion to refuse or cancel service. Violation of any of DeltaArc Networking Rules and Regulations could result in a Warning, Suspension, or possible Account Termination. Accounts terminated due to policy violations will not be refunded.

Service Cancellation
To authenticate a cancellation request, you must e-mail sales@deltaarc.net. You will be provided with a form to fill that you will need to send back. The account cancellation must be received 10 days before the next billing period.

Disclosure to Law Enforcement
We strictly forbid the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information to any law enforcement agent who makes a written request without further consent or notification to the Subscriber.

Service Rates
The subscriber acknowledges the cost for the service furnished by signing up. The subscriber knows that DeltaArc Networking May change rates from time to time and that he will be notified 30 days before any change in rates.

Payment
The set up of the service is dependent upon receipt by the Company of payment of stated charges. Subsequent payments are due on the anniversary date of the account creation. The customer is aware that sales tax will be charged if required by law.

Payments and Fees
Service will be interrupted on accounts that reach 15 days past due. Service interrupted for non payment is subject to a reconnection fee that may reach $100. Accounts not paid by due date are subject to a $5.00 fee. If you desire to cancel your account, please follow the proper procedure to do so.

Refunds
All payments to DeltaArc Networking are non refundable. This includes any fee paid, including the one time setup fee that may apply and subsequent charges regardless of usage. Any exceptions to this clause must be in the ToS or AUP to be valid.

New Domain Accounts
All new webhosting accounts involving new domains will be set up and entered into our DNS servers within 3 to 5 business days. Due to unforeseen complications, however, this process may sometimes require up to 7 business days.

Transfer of Domains
New webhosting accounts which involve the transfer of a domain from another provider to DeltaArc will require a minimum of three (3) days to be set up and entered into our DNS servers. In some cases, such transfers may take up to sixty (60) days. Due to the unpredictable nature of the transfer process, no guarantees are made regarding the amount of time a specific transfer may take. If the transfer of the domain is done by DeltaArc Networking on behalf of the account holder a handling fee will be incurred. If the customer cancels service during the transfer period for any reason, all charges are considered earned.
Support Boundaries
DeltaArc Networking provides 24 x 7 technical support to our subscribers. We will support you in any way we can, but we can not guarantee to solve your technical problems not related to our hardware or software.

Bandwidth and Disk Usage
The subscriber agrees to respect the bandwidth and disk usage limits set upon sign-up of his account. We do monitor bandwidth and disk usages. You agree to pay all extra fees related to your usage. If your usage is considered abusive, we will contact you and your account may be disabled until the issue is solved.

Indemnification
We can not be liable for any loss of business, visitors, etc.

Miscellaneous Provisions
You must provide us with, and keep current, good contact information for you. E-mail, fax, and telephone contacts are used, in that order of preference. If we fail to contact you when an issue comes up due to lack of proper contact information, we reserve the right to disable your account until proper contact information is sent.
Responsibility for Content
You are solely responsible for all the content you store on your account.
